2. What We Offer: SarDev AI Photo Lab offers digital portrait products and related creative services, including AI-generated or AI-assisted portraits created from customer-uploaded headshots and other materials. Unless a product page states otherwise, all deliverables are digital downloads or are delivered electronically.

3. Eligibility: You must be at least 18 years old, or have the legal authority to place the order and agree to these Terms on behalf of yourself or the person whose photo is being submitted.

4. Customer Uploads and Permissions: You represent and warrant that any headshot, photograph, text, or other content you upload or submit:

   • is owned by you, or you have the necessary rights and permissions to use it;

   • may lawfully be provided to SarDev AI Photo Lab for order fulfillment;

   • does not infringe the copyright, trademark, privacy, publicity, or other rights of any third party; and

   • does not contain unlawful, misleading, defamatory, abusive, or prohibited content.

5. Limited License to Process Submitted Content: To fulfill your order, you grant SarDev AI Photo Lab a limited, non-exclusive, royalty-free license to use, reproduce, process, modify, store, and transmit your submitted content solely for order fulfillment, support, quality control, recordkeeping, and related business operations. You retain ownership of your original uploaded photo, subject to this limited license.

6. AI-Generated Output and Creative Variability Our products involve AI-assisted creative workflows. You acknowledge that final results may vary from examples, mockups, previews, or written descriptions. Exact replication of any sample image, prior image, or requested detail is not guaranteed. Minor variation in lighting, composition, pose, wardrobe, background, styling, and facial rendering may occur as part of the creative process.

7. Orders, Pricing, and Payment All orders must be paid in full at checkout unless otherwise agreed in writing. We reserve the right to refuse, cancel, or limit any order at our discretion, including in cases of suspected fraud, incomplete submissions, technical issues, pricing errors, or violation of these Terms.

8. Custom Orders For custom portrait products, you are responsible for providing complete, accurate, and consistent instructions. If you purchase multiple custom portraits, you must provide the required details for each design and the quantity of each design. The total of all requested designs must match the quantity purchased.

9. Delivery Products are fulfilled digitally by download link, email, portal delivery, or another electronic method selected by us. Delivery times shown on the website or in communications are estimates unless expressly guaranteed. Delays may occur if required materials are missing, instructions are unclear, or revisions are requested.

10. Refunds and Cancellations Refunds and cancellations are governed by our separate Refund Policy, which is incorporated into these Terms by reference. Because our products are digital and often custom-made, orders are generally non-refundable once work has begun or digital delivery has been made.

11. Revisions If a product includes revisions, they are limited to the number and scope stated on the product page or in the order terms. Revisions do not include a full redesign unless expressly stated. Additional revisions may require an additional fee.

12. Intellectual Property All website content, branding, graphics, layouts, copy, workflows, prompts, product names, and other materials created or owned by SarDev AI Photo Lab remain our property or the property of our licensors, except for your original uploaded materials. You may not copy, resell, redistribute, reverse engineer, or exploit our materials except as permitted by law or with our written permission.

13. License for Delivered Portraits Unless otherwise stated on the product page or in a separate written agreement, your purchase grants you a limited, non-exclusive, non-transferable license to use the delivered portrait for personal use, personal branding, social media, websites, and internal business use. You may not resell, sublicense, redistribute, or commercially exploit the delivered file as a standalone product without our written permission.

14. Prohibited Uses You may not use the website or our products for unlawful, fraudulent, abusive, defamatory, misleading, or infringing purposes, or to impersonate another person without permission. We reserve the right to reject or cancel orders that involve prohibited uses.

15. Privacy Your use of the website is also governed by our Privacy Policy, which explains how we collect, use, store, and protect information, including uploaded photos and order details.

16. Disclaimers The website and all products and services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not guarantee uninterrupted website availability, error-free operation, or that every final image will satisfy every subjective preference.

17. Limitation of Liability To the fullest extent permitted by law, SarDev AI Photo Lab and its owners, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website, your order, your submitted content, or creative variation in AI-generated results. Our total liability for any claim will not exceed the amount you paid for the specific product or service giving rise to the claim.

18. Indemnification You agree to indemnify and hold harmless SarDev AI Photo Lab and its owners, affiliates, contractors, and service providers from claims, liabilities, losses, damages, and expenses arising from your breach of these Terms, your submitted content, or your misuse of the website or delivered products.

19. Changes to These Terms: We may update these Terms from time to time. Updated terms will be posted on this page with a revised effective date. Continued use of the website after an update constitutes acceptance of the revised Terms.

20. Governing Law and Contact: These Terms are governed by the laws of the state in which SarDev AI Photo Lab operates, without regard to conflict-of-law principles.
